汉谟拉比法典法律分类规定
一、关于诉讼审判的规定(1至5条):
其中第二条规定十分有趣,在法庭上,当一方控告另一方犯有某种罪行,然而提不出证据,被告一方也拿不出反驳的证据.这时,法官便会宣布把被告一方扔进幼发拉底河中,如果沉溺了,证明被告一方有罪.没收其全部家产归原告一方;假如不被淹死,则证明无罪.那就处死原告一方,同时把原告一方的财产没收归被告一方所有.这叫做交河神审判.
二、关于保护私有财产的规定(6至126条):
其中规定盗窃或隐藏他人奴隶的人处以死刑;欠债到期不还的人,责令其妻子和儿子两人到债主家里充当奴隶三年,第四年恢复自由.
三、关于婚姻、家庭与财产继承(127至195条).
四、关于人身保护和“同态复仇法”(196至214条):
其中规定“以眼还眼,以牙还牙”.打瞎奴隶的眼睛同打瞎耕牛的眼睛一样处理,杀死奴隶同杀死耕牛一样不偿命,只赔偿经济损失.建筑设计师设计的房屋倒塌,若压死了屋主,把建筑师处死,若压死的是房主的妻子或儿子,就把建筑师的妻子或儿子处死.

汉谟拉比和刻在石柱上的法典

1901年12月,由法国人和伊朗人组成的一支考古队,在伊朗西南部一个名叫苏撒的古城旧址上,进行发掘工作。一天,他们发现了一块黑色玄武石,几天以后又发现了两块,将三块拼合起来,恰好是一个椭圆柱形的石碑。 这块石碑高2.25米,底部圆周1.9米,顶部圆周1.65米。在石碑上半段那幅精致的浮雕中,古巴比伦人崇拜的太阳神沙马什,端坐在宝坐上,古巴比伦王国国王汉穆拉比,恭谨地站在它的面前,沙马什正在将一把象征帝王权力标志的权标,授予汉穆拉比。石碑的下半段,刻着汉穆拉比制定的一部法典,是用楔形文字书写的。其中有少数文字已被磨光。这个石碑就是著名的“汉穆拉比法典”,也是世界上最早的一部比较系统的法典。它把我们带到了近4000年前的古巴比伦社会。 古巴比伦王国位于幼发拉底河和底格里斯河流域,大体相当于今天的伊拉克。公元前1792年,汉穆拉比成为古巴比伦国王。汉穆拉比是一位很有才干的国王。他勤于朝政,关心农业、商业和畜牧业的发展。他也关心税收,处理各种案件。他在位40年,使巴比伦成了一个强盛的国家。 汉穆拉比每天要处理的申诉案件太多,简直应付不了。他就让臣下把过去的一些法律条文收集起来,再加上社会上已形成的习惯,编成了一部法典。汉穆拉比命令把法典刻在石柱上,竖立在巴比伦马都克大神殿里。 这部法典一共有282条,刻在圆柱上共52栏4000行,约8000字。圆柱挖掘出来的时候,正面7栏(35条)已经损坏,其余的基本完整。上面的字迹优美,是一种只有王室才使用的楔形字体。 汉穆拉比法典分为序言、正文和结语三部分。正文共有282条,其中包括诉讼手续、盗窃处理、租佃、雇佣、商业高利贷和债务、婚姻、遗产继承、奴隶地位等条文。汉穆拉比法典比较全面地反映了当时的社会情况。 在巴比伦社会中,除了奴隶主和奴隶,还有自由民。这部法典的很多条文是用来处理自由民的内部关系的。处理的原则就是“以牙抵牙,以眼还眼”。比如,两个自由民打架,一个人被打瞎了一只眼睛,对方就要同样被打瞎一只眼睛作为赔偿;被人打断了腿,也要把对方的腿打断;被人打掉牙齿,就要敲掉对方的牙齿。甚至有这样的规定:如果房屋倒塌,压死了房主的儿子。那末,建造这所房屋的人得拿自己的儿子抵命。 汉穆拉比法典对奴隶主、自由民、奴隶有着不同的规定:如果奴隶主把一个自由民的眼睛弄瞎,只要拿出一定数量的银子就可了事。如果被弄瞎眼睛的是奴隶,就不用任何赔偿。奴隶如果不承认他的主人,只要主人拿出他是自己奴隶的证明,这个奴隶就要被割去双耳。法典甚至规定奴隶打了自由民的嘴巴也要处以割耳的刑法。属于自由民的医生给奴隶主治病,也是胆战心惊的。因为,如果奴隶主在开刀的时候死了,医生就要被剁掉双手。 为了巩固奴隶主的统治,法典还规定了一些更严厉的条款:逃避兵役的人一律处死;破坏桥梁水利的人将受到严厉处罚直到处死;帮助奴隶逃跑或藏匿逃亡奴隶,都要处死;如果违法的人在酒店进行密谋,店主如果不把这些人捉起来,卖酒人也要被处死。 巴比伦社会里自由民还包括租种土地的小农。他们也受着奴隶主的沉重剥削,他们每年要把收获量的三分之一,甚至是二分之一缴给出租土地的奴隶主。法典中还规定:债务奴隶劳动3年可以恢复自由。但这仅仅是给自由民的一点小恩小惠。奴隶主逼迫一些还不起债的自由民成为债务奴隶,反过来又用这种规定来笼络他们。 有个名叫乌巴尔.沙马什的小农,租种奴隶主义鲁姆.巴尼一小块土地,全家人累死累活地干了一年,好不容易盼到了秋收。但是,粮食刚收上来,义鲁姆·巴尼就瞪着血红的眼睛上门逼租了。富商伊兴杜姆也上门索取乌巴尔·沙马什这年春天向他借的500斤粮食。乌巴尔·沙马什交了租,还了债再交完了各种苛捐杂税,一年的劳动成果全部付诸东流。乌巴尔·沙马什只得把子女卖为奴隶,他本人也沦为债务奴隶。 正是依靠这部法典,汉穆拉比时代的巴比伦社会,成为古代东方奴隶制国家中,统治最严密的国家。 那么这部石柱法典是怎样从巴比伦“跑到”苏撒的呢?原来苏撒也是一座5000年前的古代都城。公元前3000多年前,在今天伊朗迪兹富尔西南的苏撒盆地有一个强大的奴隶制王国,叫埃兰(又译“依兰”)。古城苏撒就是埃兰王国的首都。公元前1163年,埃兰人攻占了巴比伦之后,便把刻着汉穆拉比法典的石柱作为战利品带回到了苏撒。埃兰王国后来被波斯灭亡。公元前6世纪时,波斯帝国国王大流士上台后,又把波斯帝国的首都定在苏撒。这个石柱法典便又落到了波斯人手中。 那么发掘出来的圆柱正面7栏已被损坏,又是怎么回事呢?原来,埃兰国王打算在圆柱正面刻上自己的功绩。可是,在毁去原来的字迹后,不知为什么并没有刻上新字。 这件希世珍宝现在还收藏在巴黎的卢浮宫博物馆。圆柱上被涂毁的7栏文字,可以根据后来发现的汉漠拉比法典的泥版文书进行校补。所以,“石柱法典”仍是世界上现存的一部最古老最完整的法典。
